Terms & Conditions of Membership
1. APPLICABILITY AND SERVICE PROVIDER
These Terms and Conditions (T&Cs) govern the MEDI-AID.HELP Medical Response and Ambulance Transportation subscription service, provided by Resq Medix Ambulance Services (hereinafter referred to as "RMAS").
2. SERVICES
A) RMAS commits to offering emergency medical response and ambulance transportation services to its subscribers (members).
B) RMAS shall strive to promptly reach the location where the member requires emergency medical treatment and/or transportation, depending on the volume of prior emergency calls.
3. SERVICE AREA
The service area is periodically determined by RMAS and currently does not extend beyond the borders of the City of Cape Town Municipality/Cape Peninsula. Areas inaccessible by normal motor vehicles are excluded.
4. TERMINATION
A) Membership in RMAS may be terminated at any time with one calendar month's reciprocal written notice.
B) If a member terminates within the first three months and has received services from RMAS during that period, RMAS is entitled to charge for costs and services rendered.
5. MEMBERS DETAILS
Members are responsible for ensuring that all details provided to RMAS are accurate and up-to-date, including names, contact information, address, allergies, medications, etc.
6. MEMBERS COMMUNICATIONS
RMAS shall not permit the use of its membership database or member details for any third-party or unsolicited marketing communications. Communications will be restricted to current members and pertinent information about RMAS.
7. GENERAL MEMBERSHIP CONDITIONS
A) Membership includes all treatment and standard medical consumables provided by RMAS during a medical emergency.
B) RMAS reserves the right to decline service if it cannot respond appropriately.
C) RMAS may reject non-emergency requests or charge for assistance on a call-out fee basis, plus consumables.
8. SPECIAL MEMBERSHIP CONDITIONS RMAS
A) Standard Household membership covers one residential property with up to six people; additional individuals incur extra charges;
B) Membership subscription includes up to fifteen (15) Medical Response cases and 4 Ambulance Transportation trips to the closest hospital per year, with visitors covered for up to five (5) cases per household per year - medical response for visitors only;
C) RMAS may bill members who exceed maximum treatment numbers or do not live at the listed dwelling;
D) Non-emergency transportation is not covered and may be billed at RMAS' standard rates;
E) Points A to D are valid only for Student, Family, and Commercial subscriptions.
F) Special Care membership covers up to one (1) ambulance call-out/transportation to the hospital per month and one (1) ambulance transportation from the hospital to the retirement / frail care center per month, including up to fifteen (15) medical response callouts.
G) MEDI-AID.HELP members are entitled to one free ambulance transportation per calendar year for a hospital discharge within 50km of RMAS’s offices.
9. SUBSCRIPTION FEES
A) All membership fees must be paid in advance.
B) RMAS may increase fees by up to 10% annually for existing members.
C) Failure to pay fees may result in termination and/or billing for services rendered.
D) Fee increases due to membership changes or regulatory requirements will be communicated in advance.
10. DEBIT ORDER RETURNS
RMAS may charge a fee to cover bank charges and administration costs if a member's payment is returned.
11. CHANGES TO TERMS AND CONDITIONS
RMAS reserves the right to change T&Cs and will communicate such changes through its website, newsletters, email, or SMS.
12. SUBCONTRACTORS
RMAS can delegate obligations under this Agreement to sub-contractors, subject to the same terms and conditions.
13. LOSS / DAMAGES
A) RMAS is not liable for loss or damage arising from delays, failures to render services, or other reasons beyond its control.
B) RMAS has limited indemnity insurance; claims will be processed under this policy.
C) Member claims are limited to the insurance amount; no additional amounts are payable by RMAS.
D) Both parties agree to the jurisdiction of the Magistrate's Court for legal proceedings.
14. SEVERABILITY
Each term is severable; if any term is invalid, the Agreement shall be enforced as if such term was not included.
